This Privacy Policy details how RedSky Technologies Ltd, (CIN: U74999MH2016PTC297350), a private limited Company, having its registered office at 91SpringBoard, Lotus Star, Plot No.D-5, Road No. 20, Marol, MIDC, Andheri (E), Mumbai- 400069 (hereinafter referred to as “RedSky/We”, which expression shall unless repugnant to the context or meaning thereof, be deemed to include its successors and assigns), collects, stores, handles, and processes personal data provided to us, as well as data which we automatically collect when you use our Services. By choosing to use our Services, or accepting our License Agreement, you consent to all of the terms of this Privacy Policy. 

Personal data means any information that relates to an identifiable individual. Personal data does not, however, include data that has been randomized, aggregated, or pseudonymized such that it cannot be associated with a specific individual.

If you do not agree with the terms of this Policy, please do not use or access our services. By continuing to use our services, you consent to the data procedures described in this Policy.

1. INFORMATION WE COLLECT

RedSky provides several services through its website, mobile and desktop applications, and hardware products (collectively, “Services”). When you use the Services, we may receive your data in a number of ways. 

A. Information we collect when a merchant’s customer uses a RedSky-enabled POS

When you make a payment at a RedSky-enabled POS location, we collect information about the transaction, which may include your personal data. This may include the details of the mode of payment, details of the purchase (such as the date, time, value, and goods purchased), , name and address of the merchant where the transaction took place.

Depending on how the merchant has configured its RedSky-enabled POS, we may collect additional personal information, including but not limited to your email address or phone number. 

Merchants using RedSky-enabled POS units may provide us with information about their customers, such as email addresses, phone numbers, and purchase history, particularly when we perform additional services such as managing promotional schemes or communications for the merchant.

B. Information we collect about merchants and their employees/affiliates

We may collect personal data directly from merchants (including prospective customers) about themselves and their employees/affiliates. The types of information we collect may include:

  1. Contact information of the merchant and its personnel who interact with us, such as name, job title, address, and contact details which may include email addresses and phone numbers.
  2. Account information, such as usernames, passwords, and other such personal data that a user may input while registering an account with us.
  3. Details such as date of birth, citizenship, and residential status.
  4. Relationship with the business, such as whether the user is an owner, employer, authorized signatory, or employee of the business.
  5. Government-issued identification numbers (to the extent permitted under applicable law), such as a PAN, Aadhar, Driver’s License, or any other relevant identification document.
  6. Customer service requests or interaction on any social media platform.
  7. Information such as total payments made at a merchant’s location; details of payment methods used by customers; merchant’s bank details; details of transactions at a merchant’s location, including but not limited to transaction volumes, amounts, type of goods sold, and refunds given.
  8. Information pertaining to a merchant’s use of RedSky services such as account information, analytics, promotions, customer communications, and service requests. 

C. Information about job applicants

We collect information provided to us by individuals applying to RedSky for employment opportunities. This includes names, contact information, professional skills, education and work history, and any other relevant information that may be included on a curriculum vitae. This information may be collected either when an individual provides it to us directly or if any third-party recruitment services provide it to us. We are not responsible for the data collection and processing practices of any third parties.

D. Automated information collection

When you access our website or services, we (and our partners) may automatically collect information about you. This may include information about your computer or mobile device, and activities on our website and applications. This information usually includes details of your operating system, browser, screen resolution, IP address, browsing history just prior to visiting our website, location data, and information regarding your use and actions of our website and applications. 

This information is collected via various mechanisms, such as via cookies, web beacons, and similar technologies. Please refer to our section on cookies (directly below) for more details. You can choose to disable cookies or to opt out of the use of your browsing behaviour for purposes of targeted advertising.

E. Cookies and server logs

We use cookies and other technologies to collect information from our Services. A cookie is a small amount of data generated by a website and saved by your web browser. Its purpose is to remember information about you, and customizes the user experience on a website or mobile application, as well as streamlining it. Similar to the section above, this may include the date and time of your visit, time spent on our Services, and your browsing locations before and after using our Services.

F. Information from third-party platforms

We may collect information that is publicly available, such as government lists, public databases, and social media websites. We may also request information from credit score providers and fraud prevention agencies, as permitted under law. We may also maintain pages on popular social media platforms such as Facebook, Twitter, Instagram, LinkedIn, and any other such platform. We may collect information from you based on your interaction with our pages on those platforms. In those cases, the relevant third-party platform’s privacy policy will apply to that information. 

2. WHAT WE DO WITH YOUR INFORMATION

We use the data we collect for the following purposes:

A. Providing and improving our products and services

This includes:

  1. Operating, evaluating, maintaining, improving, and providing the features and functionality of our products and services
  2. Managing our relationship with customers, clients, and merchants.
  3. Exercising our rights and obligations as defined in our EULA and Terms of Service.
  4. Communicating with registered users of our Services by sending relevant emails or messages (e.g. for the purposes of account verification, updates, changes, alerts, support). 
  5. Personalization and customization of our products and services.
  6. Maintaining records for our merchants, including their own activities as well as their customer’s purchase history.
  7. Prevention of fraud, money-laundering or any other white-collar crimes. 
  8. Risk management.
  9. Support and maintenance for our services.

B. Research and development

We may use the data we collect for our own research purposes, including improving our services as described directly above, as well as for creating and developing analytics and related reports thereof.

C. Marketing

We may share your personal data with trusted third-parties who facilitate our continued provision of the Services. This may include financial institutions, banks, verification services, process bureaus, and Consumer Packaged Goods (CPG)companies. 

We may allow RedSky-enabled merchants or our customers to send you marketing materials and communications if you have already provided your personal data to a merchant using a RedSky-enabled POS.

We may also pseudonymize your personal data to ensure that you are not personally identifiable from it, and share the pseudonymized data with third-parties for marketing, analytics, and research purposes. Wherever required by law, we will obtain your express opt-in consent before we share your personal data with any third-parties. 

Wherever applicable, you may request us to stop sending you marketing messages by using the details in the Contact Us section below. Should you opt out of such messages, we may still send you non-marketing communications for our lawful purposes.

If you are the owner or employee of a store where a RedSky device is installed, we may use the data collected regarding your mobile number or any other contact details to prevent you from participating in promotional or marketing schemes that we may run.

D. Employment

We may process information about job applicants to facilitate our recruitment and other lawful business activities. 

E. Compliance

We may use your data as necessary to comply with applicable laws, regulations, and processes. This includes receipt of requests from governmental and law enforcement agencies. 

We may also use your data as necessary to enforce the terms of use of our Services, detect fraud, and protect our rights and interests.

F. Consent

We may be required to obtain your express consent in certain situations. In such cases, you have the right to withdraw your consent at any time in the manner stated while we obtained your consent, or by contacting us at the addresses below. If you have consented to receive communications from third-parties who use our Services, you must contact those third-parties directly.

3. WHO WE SHARE YOUR DATA WITH

We may share your data with merchants who avail of our Services. For example, we may collect data about a merchant’s customers and we may provide that data to merchants upon request, in compliance with applicable data protection laws. We will not be held responsible for the data processing and privacy practices of merchants who use our Services.

We may provide your data to third parties who are involved in the payments process, such as banks or card issuers. 

We may provide your data to our professional advisors (lawyers, bankers, auditors, insurers), as well as credit, fraud protection, and verification agencies where necessary to allow us to discharge our lawful business functions. All such disclosures shall be performed in the manner required by applicable laws.

We may also disclose your personal data to appropriate law enforcement agencies or third-parties as mandated by law or court orders.

4. YOUR RIGHTS

You may choose not to share personal data with us; please note however, that this may affect your ability to use our Services. If you are a merchant, we will immediately cease providing our services to you if you choose not to share any personal data from your store.

We may contact you with details of new services or offers. You may choose to stop receiving these communications in the manner mentioned in the said communications, or by contacting us at the addresses given below. You may still however, continue to receive communications relating to your account. 

If you have a right to access, modify, or delete your data as granted in certain jurisdictions, you may contact us directly to exercise such right. You acknowledge that we may not be able to comply with your request in all circumstances.

We may be obligated to retain your data for the purposes of fraud prevention, transaction settlement, and compliance with applicable laws. In such cases, we may retain your data even after you cease to use our Services or request deletion of the data.

5. HOW WE PROTECT YOUR DATA

We take all reasonable measures and adhere to industry standards to ensure the safety and security of your data. We maintain strict procedures, whether they are technical or administrative, to ensure the security of your data.

Access to your data by our employees or service providers is granted on a strict need-to-know basis, and such access is granted on our instructions and they are subject to confidentiality and non-disclosure obligations.

We also have engaged appropriate physical controls and encryption protocols to ensure the safety of your data.

We may provide links to websites, content, and applications maintained by third-parties. We do not make any representations, nor can we be held responsible for their privacy practices and processes. We do not endorse or approve any material that may be displayed on third-party platforms that we may link to and visiting or viewing any such content is solely at your own risk.

We reserve the right to amend or alter this Policy from time to time, as may be required in accordance with law or our industry/commercial practices. If material changes are made to this Policy, we will update the same on our website and applications along with the date of such change. If we have your email address, we may (and where required by law, will) also intimate you of such changes via email.

Any such amendments will be considered effective upon such notification as described above. Your continued use of our Services after such changes will be considered as acceptance.
